Terms of Service

These terms apply when a client orders or accepts Japan EV Field Lab services. The service is primarily intended for manufacturers, developers, distributors, sellers, and other business customers. If a written project agreement conflicts with these terms, the written project agreement controls for that engagement.

Before work begins, the parties confirm the question to answer, product and vehicle version, evidence level, deliverables, schedule, price, payment milestones, confidentiality, sample handling, and safety limits. Work outside that scope requires written agreement and may change the fee or schedule.

• Provide accurate, complete, and timely product specifications, manuals, claims, known issues, accounts, test instructions, and priority questions.
• Confirm that the client has authority to provide products, software access, personal data, copyrighted material, and confidential information used in the engagement.
• Ensure products are lawfully exportable/importable and disclose batteries, hazardous materials, security risks, or special handling requirements before shipment.
• Do not request unsafe, unlawful, deceptive, or undisclosed surveillance activity.

Japan EV Field Lab may refuse, pause, or stop work that could harm people, the vehicle, property, data, or legal compliance. Brakes, steering, suspension, high-voltage systems, and ADAS modifications are excluded. If the client did not disclose a material risk, fees for completed work and committed costs remain payable.

Findings apply only to the specific vehicle, market, product version, firmware, documentation, environment, and scenarios stated in the report. Vehicle software and product designs can change. A successful test is not certification, homologation, legal approval, universal compatibility, or a sales guarantee.

A negative, inconclusive, incompatible, or non-reproducible result is valid work when the agreed method was performed. Unknowns, limitations, and deviations are reported rather than concealed.

Payment timing, additional costs, cancellations, and refunds follow the written proposal and the Commercial Disclosure page. Japan EV Field Lab may withhold work or delivery while an amount is overdue. Each party will promptly communicate circumstances likely to cause a material delay.

The client retains ownership of its sample. Return, retention, donation, or disposal is agreed in writing. Shipping, customs, insurance, return costs, and risk in transit are the client’s responsibility unless agreed otherwise. Japan EV Field Lab is responsible for reasonable care while a sample is in its custody, but not for ordinary test wear or defects inherent in the sample.

Client identity, unreleased products, access credentials, reports, and test results are private by default. Japan EV Field Lab will not publish them without written permission, except where disclosure is required by law or necessary to professional advisers and service providers bound by appropriate duties. The client must identify highly sensitive information before sharing it.

After full payment, the client may use the final report and agreed deliverables internally for product, listing, support, and launch decisions. Public publication, resale, sublicensing, or use of Kaz’s name as an endorsement requires written permission. Each party retains its pre-existing materials. Japan EV Field Lab retains its general methods, templates, know-how, and non-client-specific learnings without revealing confidential information.

Japan EV Field Lab is independent and is not affiliated with or endorsed by Tesla, Inc. Services are product research and owner-use testing, not engineering certification, legal advice, regulatory approval, vehicle repair, or a substitute for the client’s own quality and compliance program.

To the extent permitted by law, neither party is liable for indirect, incidental, special, punitive, or consequential loss, including lost profits or lost opportunity. Japan EV Field Lab’s aggregate liability for an engagement is limited to the fees paid for that engagement. These limits do not apply where prohibited by law or to intentional misconduct or gross negligence.

These terms are governed by Japanese law. The Tokyo District Court has exclusive agreed jurisdiction for disputes, unless mandatory law provides otherwise. If the English and Japanese versions conflict, the Japanese version controls. Questions or notices may be sent to lab@kurematsu.net.
